Report of the Impartial Administrator, First Deputy Impartial Administrator, Second Deputy Impartial Administrator and Tallying Committee with respect to the 2001 Election of Certain Officers and Executive Board Member of American Maritime Officers, pursuant to ARTICLE XI, Section 4, (a), (b), (c) and (d) of the National Constitution of American Maritime Officers

In accordance with ARTICLE XI, Section 4, (a), (b), (c), (d), (e), (f) and (i) of the National Constitution of American Maritime Officers, submitted herewith is the Report of the Impartial Administrators and Tallying Committee with respect to the 2001 Election of Certain Officers and Executive Board Member of American Maritime Officers.
A Special Meeting was called at the direction of the National President of American Maritime Officers, to be held on November 26, 2001, for the purpose of electing members of the Tallying Committee in each of the three (3) Constitutional Ports, (Dania Beach, Florida, Brooklyn, New York and Toledo, Ohio). The Tallying Committee's function, together with the Impartial Administrators, is to tally all Ballots and prepare a Report, including a complete accounting of all Ballots and Ballot Envelopes, and reconcile the same with the Rosters and the Verification Lists of Membership.
The AMO National Constitution provides that the Tallying Committee shall consist of not more than five (5) members and two (2) alternates in good standing from the Ports of Dania Beach, Brooklyn and Toledo respectively, as follows: Two (2) members and one (1) Alternate from Dania Beach; two (2) members from Brooklyn; one (1) member and one (1) alternate from Toledo.
Special Meetings at the Ports of Dania Beach, Brooklyn and Toledo were held on November 26, 2001, resulting in the following named members and alternates being duly elected to constitute the Tallying Committee:

The Tallying Committee elected Douglas Heller, 283-H as the Chairman of the Committee and Mark Aiken, Book # A-165 as Secretary on December 3, 2001, prior to proceeding to the Depository with the Impartial Administrator and First Deputy Impartial Administrator for the Ballots.
During the regular membership meeting held on December 3, 2001, in the Port of Dania Beach, the Impartial Administrator, 1st Deputy Impartial Administrator and the Tallying Committee proceeded to the designated Depository for the Ballots of the AMO 2001 Election of Certain Officers and Executive Board Member, arriving at the office of said Depository at approximately 2:00 P.M. of said day. The Impartial Administrator, 1st Deputy Impartial Administrator and the Tallying Committee then removed all of the Ballots from the custody of the said Depository, counted 1,296 (*1) ballots, and placed them in an empty Ballot Box in the presence of the entire Tallying Committee, the Impartial Administrator, the 1st Deputy Impartial Administrator and the three (3) member observers present pursuant to ARTICLE XI, Section 4(a), third paragraph of the AMO National Constitution. The Ballot Box was then locked and brought to the American Maritime Officers Headquarters (School Building) under continuous observation by the Impartial Administrator, 1st Deputy Impartial Administrator and the Tallying Committee. The said Ballot Box, in the presence of the Impartial Administrator, 1st Deputy Impartial Administrator and Tallying Committee, and member observers, was unlocked, opened and the Ballots therein were then counted again, checked and verified for eligibility to vote against the Current Membership Roster by the Tallying Committee.
The counting, tabulating and final tallying of Ballots were openly conducted, taking place at Union Headquarters, (School Building) on December 3rd and 4th, 2001, in the presence of persons legitimately present (candidates, observers for candidates and members in good standing, all of whom met the requirements of ARTICLE XI, Section 4(b), second paragraph). Security personnel were present during the entire counting of the Ballots and were otherwise present on a twenty-four hour basis to guard and protect all election materials. At approximately 9:00 P.M. the Committee decided to adjourn until 8:00 A.M. on December 4, 2001. During the night of December 3rd, all Ballots and election materials were placed in the Ballot Box under lock and key, and sealed with tape which was signed by the Tallying Committee, Impartial Administrator and 1st Deputy Impartial Administrator.
The Ballot Box was opened on the morning of December 4, 2001, at 8:00 A.M. by the Impartial Administrator, 1st Deputy Impartial Administrator and the Tallying Committee. They confirmed that the Ballot Box had been undisturbed overnight with all candidates present agreeing with this finding. The Ballot Box was then reopened and the Tallying Committee recounted the outer envelopes and confirmed the number of outer envelopes placed in the Ballot Box the previous night remained the same. The Impartial Administrator retained all keys to the Ballot Box lock at all times.
Relevant Election figures are set forth below:
- Total Ballots (*2) and Ballot Envelopes received from the printer: 4,500
- Total Ballots and Ballot Envelopes mailed on 10/01/01: 1,267
- Total Ballots (*3) and Ballot Envelopes mailed 10/02/01 thru 11/15/01: 983
- TOTAL: 2,250
The result of the count and final tally of Ballots was as follows:
- Total Ballots (*1) on hand: 2,248
- Total Ballot Envelopes on hand: 2,250
- Total Eligible Ballots determined from roster validly cast: 1,256
- Total Void (*2) Ballots: 30
- Total unresolved challenged Ballots: 10
- Total Envelopes picked up from the Depository: 1,296
- Total Ballots and Ballot Envelopes unreturned: 954
- Number of Ballot Packets received from Printer (Numbered 1 to 4,500): 4,500
- Number of Ballot Packets mailed from Roster (Numbered 1 to 2,157 plus 93 Duplicates): 2,250
Ballots were declared Void for the following reasons:
- Received by Depository after 12/01/01 thru completion of the count: 12
- No signature on return envelopes addressed to Depository: 4
- Opened return envelope: 1
- Duplicate (*3) and original both returned: 3
- Wrong Signature: 2
- Photo copy instead of Original Ballot: 1
- Identifying marks on Ballot: 3
- Challenged Ballots: 36
At the start of the count there were thirty-six (36) challenged Ballots in the following categories:
- Saturday, December 1, 2001 mail delivered to Bank on 12/03/01: 18
- Paid the 3rd quarter not good on Check-off list: 9
- Seabulk Tanker Members: 9
At the conclusion of the count the Committee resolved the following challenged Ballot categories as eligible:
- Saturday, December 1, 2001 mail: 18
- Check-off Members: 3
- Member incorrectly classified as Seabulk member: 1
The Committee resolved the following challenges and determined them to be ineligible and therefore VOID:
- Check-off Members: 4
The Committee deferred making a determination on the following categories:
- Check-off Members: 2
- Seabulk Tanker Members: 8
- The total valid Ballots to be counted: 1,256

It is further CERTIFIED that the Candidate having the largest number of votes cast next to his name is ELECTED to the office under which his name appears pursuant to ARTICLE XI, Section 5, and ARTICLE VII, Section 4, of the AMO National Constitution.
There having been no protests or objections interposed to the conduct of the check, count and final tally of the Ballots, and there being no discrepancies brought to the attention of the Impartial Administrator, 1st Deputy Administrator and the Tallying Committee, and none otherwise having been found, the Impartial Administrator, the 1st Deputy Impartial Administrator and the Tallying Committee DO HEREBY CERTIFY that the results of said Election, as herein reported, are accurate in all respects and that each of the candidates received the number of valid ballots cast next to his name.
Accordingly, the Impartial Administrator, 1st Deputy Impartial Administrator and the Tallying Committee request that the Membership be reconvened at 10:00 A.M. on December 5, 2001, and that the Impartial Administrator, in the presence of the Tallying Committee, submit this Report to the Membership and, at the same time, read the results of the Election to the Membership and that copies of this Report be read to the Membership at Meetings in the Ports of Brooklyn, New York and Toledo, Ohio during the AMO Membership Meetings held this week.

*1.This amount includes a total of 12 Ballots delivered on Monday, December 3, 2001, after the December 1, 2001 deadline. These ballots were declared void by the committee, placed in a separate envelope, and then placed in the Ballot Box.
*2.The Ballots initially printed were objected to as having incorrect names of certain candidates. This objection was made when Ballot packages were being prepared for mailings prior to 10/01/01 and was corrected to the satisfaction of the Impartial Administrator, 1st Deputy Impartial Administrator, 2nd Deputy Impartial Administrator and objecting candidates with initial printing shredded and another set correctly printed and timely delivered by the printer.
*3.This includes 93 Duplicate Ballots.
*4.The printer printed more than 4,500 ballots. When the extra ballots were shredded, two (2) too many were shredded.
*5.This amount includes 4 Ballots voted as ineligible by committee while resolving challenged Ballots.
*6.During the process of resolving challenged Ballots the committee discovered that a duplicate Ballot had been returned from a member who had already returned an original Ballot. This ballot was voided, however, it was too late to retrieve and void the original which had been already counted. This discrepancy had no impact on the outcome.
